TERMS OF USE
The Visitor/User of the services on the website and/or the BORN2PARTY application hereby consents to the following terms of use, which apply to all content, pages, graphics, images, photographs, and any files included or uploaded on the website or the BORN2PARTY application. Therefore, they are required to carefully read these terms before visiting or using the pages and services of the website and/or the BORN2PARTY application. If they do not agree, then they must refrain from using the services and content of the BORN2PARTY application. The Visitor/Registered User is requested to check the content of these pages for any changes. Continuing to use the website and/or the BORN2PARTY application even after any changes signify the unconditional acceptance of these terms.
Definitions
- A "Visitor" is defined as a person who visits the borntoparty.app website and/or the application without being a "User" thereof.
- A "Registered User/User" is defined as a person who has registered on the website and/or the BORN2PARTY application by entering the required information and has access to all the functionalities of the website and/or the BORN2PARTY application.
- A "Host" is a Registered User who creates an invitation for an occasion of their own and shares its link with the people they are inviting.
- A "Guest" is a person who opens an invitation from the link a Host shared with them and responds to it. A Guest does not need to be a Registered User.
- An "Invitation" is the page a Host creates and shares, which carries the details of the occasion and collects the Guests' responses.
- An "Event Creator" is the creator of the event.
- An "Attendee of the Event" is a person included in the Attendee List of the Event and who has expressed their intention to participate in the event.
- An "Attendee List of the Event" is the section of the website and/or the application created exclusively by the Registered User and includes the personal information of third parties who will attend an Event.
- An "Account Profile" is the section of the website and/or the application accessible exclusively by the Registered User.
- A "Search" is the section of the website and/or the application where all active Events are displayed.
- An "Event Addition" is defined as the section of the website and/or the application where the Registered User can submit an upcoming Event.
- "Filters" refer to the section of the website and/or the application where the registered User configures the search criteria for Events.
- An "Event Management" is the section of the website and/or the application where the Registered User has access to the Events they have shown interest in.
- A "Donation" is the section of the website and/or the application where the Registered User has the option to make a donation to the website and/or the application.
- A "Feedback" is the section of the website and/or the application where the registered User can provide feedback on the website and/or the application.
- A "Link" is an electronic address of a website located outside the borntoparty.app website.
- "Website" or "Site" or "BORN2PARTY website" or "BORN2PARTY site" refers to the website: borntoparty.app
- "Application" refers to the BORN2PARTY application.
Terms of Registered Users
2.1. Registration - Account Creation
Only Registered Users have the ability to use the full range of services of the website and/or the application. Any User wishing to register may create their personal account using their Google account login credentials. The website reserves the discretion, without any liability, to reject account creation requests. You can view the Privacy Policy to understand what information we collect during your registration process and how we use it. The User is solely responsible for maintaining the security of their account. They are fully responsible for any action or activity taken on the account or through it, and the website and/or application bear absolutely no responsibility.
2.2. Creating an Invitation
A Registered User may create an Invitation by choosing a design and entering the details of the occasion.
2.2.1. An Invitation provides the Host with the following capabilities:
a) choosing a design from those the website offers; b) entering the names of the hosts and the title of the occasion; c) entering the date and time; d) entering the place; e) entering a text addressed to the Guests; f) adding questions that Guests answer when they respond; g) offering several possible dates for the Guests to choose between; h) sharing the Invitation by a link; i) seeing the responses collected, subject to clause 3.8.
2.2.2. An Invitation provides the Guest with the following capabilities: a) reading the details of the occasion; b) answering whether they are coming; c) answering any questions the Host has added; d) indicating which of the offered dates suit them; e) changing their answer afterwards.
2.3. Who Can See an Invitation
An Invitation is not listed anywhere on the website and is not indexed by search engines. It is reached only through the link the Host shares, and anyone holding that link can open it. A Host who shares the link publicly should expect it to be opened publicly.
2.4. Content of an Invitation
2.4.1. The Host who creates an Invitation is solely responsible for its use by any visitor, registered User, or third party. The BORN2PARTY website bears no responsibility for the security of the above or for the information contained therein, including photos, links, texts, and messages of any kind posted by the creator or other registered Users. The availability and use of the above are subject to all the present general and special terms of use of the BORN2PARTY website. The BORN2PARTY website reserves the right at any time not to allow the publication or posting of any photo, link, text, or message selected by the registered User or to delete them. Non-use of this discretion does not make the BORN2PARTY website responsible for the content of the personalized page and for any violation of the present terms of use.
2.4.2. While registered Users of the BORN2PARTY website are obliged to provide accurate personal information, the BORN2PARTY website is not obligated to ensure the correctness of this information.
2.5. Sending - Posting Messages on the Event Page
The process of sending/posting messages through the event page is governed by the terms herein. If any registered User does not agree with these terms, please do not use this particular service. Messages are not directly subject to content control by the BORN2PARTY website as they are sent without prior content review and processing, and therefore do not necessarily reflect the views or beliefs of the BORN2PARTY website. Therefore, the BORN2PARTY website assumes no responsibility and is not liable for any problems arising from communications via messages containing errors, omissions, or inaccuracies, forgery, tampering, or containing offensive terms, malicious defamation, deliberate or negligent behavior.
Terms of Registered Users
3.1. Posting of Photos and Links by Users
3.1.1. The website BORN2PARTY allows registered Users to post photos. The User declares and guarantees: 1. That they are the creator and have all related intellectual property rights and any other rights on each posted photo they post or store on the website and on each provided service thereof, or that they have obtained the relevant intellectual property rights and any other rights on the posted photo. They also declare that the photos do not depict minors under the age of 14 and that they have obtained the explicit and unconditional consent of all individuals depicted in them to grant their relevant rights to the extent necessary for the purposes of this. That in any case the posted photos and/or any text in them do not violate the provisions of current legislation, do not infringe intellectual property rights of third parties, and do not contain material that is obscene, defamatory, threatening, or otherwise illegal or tortious.
3.1.2. The User is also granted the right to post links on an Invitation to other websites, which they personally control, manage and/or maintain and for which they bear full responsibility. The posting of links to third-party websites is carried out at the sole responsibility of the posting user.
3.2. Information and Data Provided or Published by the User
The BORN2PARTY website cannot guarantee the accuracy and completeness of the information provided by Users regarding the events published on the platform and bears no responsibility for the content of any publication. The BORN2PARTY website reserves the right to reject or delete any content, information, and data uploaded by Users that violates the terms of use of the BORN2PARTY website, current legislation, morality, or public order.
3.3. Message Boards
3.3.1. The process of exchanging/posting messages through the event page via message boards is governed by the terms herein. If any registered User does not agree with these terms, please do not use this particular service. Messages are not directly subject to content control by the BORN2PARTY website as they are posted without prior content review and processing. Therefore, the BORN2PARTY website assumes no responsibility and is not liable for any problems arising from communications via messages containing errors, omissions, or inaccuracies, forgery, tampering, or containing offensive terms, malicious defamation, deliberate or negligent behavior.
3.3.2. The registered User who utilizes the message board and posts content thereon is solely responsible for the legality of this use and for the content of the messages. Users who use this service agree that the name with which they are registered on the BORN2PARTY website and the messages they post on the chat board are accessible to all users of that specific chat board. Users who post on message boards undertake to: a) Refrain from posting any content that is defamatory, abusive, harassing, threatening or in any way harmful; b) Refrain from any activity that infringes on the legal rights of others; c) Not post messages that constitute personal attacks or that contain abusive language; d) Not post messages that promote illegal activities; e) Not post any information that violates the privacy of third parties.
3.3.3. The BORN2PARTY website may record the content of messages posted by Users on the website solely for the purpose of detecting violations of their terms of use and for no other purpose. Requests from users for the deletion of messages and information posted on chat boards will only be accepted in special cases and if there is an extremely serious reason. You can send your request to [email protected], clearly stating the information you wish to delete.
3.4. Liability for Third-Party Content - Links from the Website to Content on Other Pages
The BORN2PARTY website cannot guarantee the accuracy and completeness of the information provided by Users regarding the events published on the platform and bears no responsibility for the content of any publication. The BORN2PARTY website may include links to other websites maintained by third parties. These links are provided solely for convenience and the BORN2PARTY website bears no responsibility for the content of those websites or for any damage that may arise from their use.
3.5. Intellectual and Industrial Property Rights
Except where explicitly indicated otherwise, all content published on the BORN2PARTY website and/or the application, including distinctive marks, logos, emblems, trademarks, names, photos, illustrations, images, drawings, digital modifications, text, services, and products are intellectual property of the BORN2PARTY website and are protected by the relevant provisions of Greek law, EU law, and international conventions. Any reproduction, distribution, transmission, modification, or other use of any content of the BORN2PARTY website without the prior written permission of the BORN2PARTY website is prohibited and constitutes a violation of intellectual property rights.
3.6. User Obligations & Liability
The registered User/visitor is prohibited from using the BORN2PARTY website and/or the application for: a) Sending, publishing, transmitting, or otherwise making available any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable; b) Impersonating any person or entity or misrepresenting their affiliation with any person or entity; c) Sending unsolicited communications (spam); d) Transmitting any content that infringes on patents, trademarks, trade secrets, copyrights, or other proprietary rights; e) Transmitting any viruses or other computer code designed to disrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment.
3.7. Reporting Issues
The BORN2PARTY website encourages Users to report any problematic content or activity they encounter on the platform. If you believe that any content or activity on the BORN2PARTY website violates these Terms of Use, please contact us at [email protected].
3.8. Payments
Creating an Invitation and sharing it is free, whichever design is chosen, and every Guest can always respond at no cost to them. A free Invitation shows the Host the first twenty five responses it receives. To see the responses beyond that, the Host pays once for that Invitation, and every response to it remains visible to them thereafter.
That payment is a single payment for a single Invitation. It is not a subscription: nothing renews, and there is nothing to cancel. The price shown at the point of payment includes VAT. Payments are processed by a third party payment provider, and the BORN2PARTY website does not receive or store card details.
The BORN2PARTY website reserves the right to change what is offered free of charge and what is paid for. In such a case, the User will be notified in advance and will have the option to accept or decline the new terms. A change of this kind does not affect an Invitation that has already been paid for.
3.9. Termination of BORN2PARTY Website Usage
The BORN2PARTY website reserves the right to terminate a User's access to the website and/or application at any time and for any reason, including if the BORN2PARTY website believes that the User has violated these Terms of Use. Upon termination, the User's right to use the website and/or application ceases immediately.
3.10. User Codes
The registered User is responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. The registered User agrees to notify the BORN2PARTY website immediately of any unauthorized use of their account or any other breach of security.
3.11. Acceptance of Terms of Use
By accessing and using the BORN2PARTY website and/or application, the User accepts these Terms of Use in their entirety. If the User does not agree to these Terms of Use, they must not use the BORN2PARTY website and/or application.
3.12. All Terms of Use are essential.
All terms and conditions set forth in this document are considered essential and form the basis of the agreement between the User and the BORN2PARTY website. The failure of the BORN2PARTY website to enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.
3.13. Partial Invalidity
If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
3.14. Waiver
The failure of the BORN2PARTY website to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.
3.15. Applicable Law and Jurisdiction
These Terms of Use are governed by and construed in accordance with Greek law. Any disputes arising from these Terms of Use shall be subject to the exclusive jurisdiction of the courts of Athens, Greece.
Limitation of Liability
The BORN2PARTY website provides its services "as is" and makes no representations or warranties of any kind, express or implied, as to the operation of the website and/or application, the information, content, materials, or products included therein. The BORN2PARTY website does not guarantee that the website and/or application will be available at all times, error-free, secure, or that defects will be corrected. The BORN2PARTY website shall not be liable for any damages of any kind arising from the use of the website and/or application, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
